Former Wayne County nursing home CNA sentenced to jail for sexually abusing one victim; exposing self to 84 year-old resident

Louis Magrino, age 63, of 22 Phelps Street in the Town of Lyons, was sentenced on Thursday (9/15) in front of Judge John B. Nesbitt in Wayne County Court to four months of jail on weekends and 10 years of probation on his prior plea to 11 counts, including Sexual Abuse in the 1st Degree and Endangering the Welfare of an 84 year-old female Wayne County Nursing Home resident. Magrino is required by law to be registered as a sex offender based on this conviction.

Police had investigated that Magrino had oral sex with a female visitor in a nursing home resident’s bathroom. Hours later he reportedly sat on the end of a female resident’s bed and masturbated. In a separate incident, Magrino also exposed his genitals to an 84 year-old female resident while making lewd comments.

Magrino is convicted of committing numerous criminal offenses while working at the home in April of this year, including sexually abusing a woman visiting her 99 year old mother at the nursing home. Magrino also victimized the 99 year old resident by placing her in the bathroom facing the wall while he sexually abused her daughter by forcibly touching her breasts. The New York State Attorney General’s Office handled the prosecution of the case.

Wayne County Sheriff Barry Virts, called what “bizarre behavior”. On Monday (5/2) the Wayne County Sheriff’s Office arrested Louis F. Magrino.

The investigation was handled by the Sheriff’s Office and the New York State Attorney General’s Office.

Magrino had worked at the facility for 9 years. He was out on $2000 cash/$5000 since his arrest.

Sheriff Virts, after Magrino’s sentencing, said that with the 10 year probation and registering as a sex offender, these conditions would prevent him from ever harming a vulnerable population.
