Animal found with open wounds, saturated with blood, covered in maggots and flies
The Wayne County Office of the Sheriff reported the arrest on Tues- day (11/30) at 12:53 p.m. of a Town of Lyons man following the investigation into a complaint involving the unhealthy condition of his dog.
Calan W. Lopinto , age 51, of 30 Butternut Street Apt. 2 in Lyons, was charged with one count of Failing to Provide Proper Sustenance under the New York State Agriculture and Markets Law.
Lopinto said that he had no way of transporting the 16 year-old dog, a pit bull named “Dutch’ to the vets and called the animal control to come and help him with the sick dog.
An animal control representative
took one look at the dog and his condition and scolded Lopinto for allowing the situation to deteriorate.
A search warrant was issued on July 15, following a phone call to the Town of Lyons Animal Control. Lopinto’s dog was located in his garage with open, draining neck wounds, saturated in blood, and covered in maggots and flies. He was quickly taken to the Lyons Veterinary Clinic in an attempt to provide proper care, but had to be euthanized due to his condition.
It is alleged that Lopinto, knowing the condition the dog was in, failed to provide for or see that the dog got proper medical attention for his failing medical condition, causing him cruelty and suffering. Lopinto was released on an appearance ticket and is scheduled to appear in Town of Lyons Court at a later
date to answer to the charge.
